| 内容記述 | The UK left the EU in January 2020. At the same time, the UK needed new environmental act for post-Brexit. It was the Government's intention that, existing EU legislation will be "rolled-over" post Brexit as far as practicable until there is an opportunity for extensive review. The new environmental legislation, the Environment Act 2021, took effect in November 2021. This Act established environmental principle as same as the EU. The EU environmental principles have been given legal effect in EU law, however, the UK environmental principles do not have direct legal effect in domestic law but must be reflected in the statement issued by the Secretary of State. The effect of UK environmental principles remains to be seen. We need to pay attention to case law in UK national courts. |
